Whenever a Health Act business changes proprietors a transfer of the Health Act registration must be completed. Prior to purchasing an existing Health Act business it is strongly recommended that an up-to-date Health Act transfer inspection be conducted so that the purchaser knows exactly what they are buying.
Health Act Transfer Inspection:
- Consent by the current proprietor must be obtained before any information can be released to the purchaser. A proprietor consent form must be completed and signed by the current proprietor (select Consent Form (Health Premises) from RELATED DOWNLOADS box).
- Once Council receives the consent form and the appropriate fee for a transfer inspection an inspection can be organised (select Health Act Fees & Charges from RELATED DOWNLOADS box).
- A typed copy of the Health Act transfer inspection is sent to the purchaser or their solicitor as indicated on the consent form. Council will expect the items of the transfer inspection to be completed according the time frames specified. It is up to the proprietor and the purchaser who will be responsible for completing these items.
Transfer of Registration
A transfer of Health Act registration form (select Forms and Guides at the end of this page) must be completed and signed by both parties. This form must be lodged with Council's Health Services with the appropriate fee (select Health Act Fees & Charges from RELATED DOWNLOADS box).
