Temporary Food Stalls

A temporary food stall must be registered with Council under the Food Act 1984.  It is expected that these stalls will primarily operate during festivals, fetes and fairs.  A temporary Food Act registration can only be granted to a group, person or organisation for 12 events per annum. 

Any event in excess of 12 events will be registered as a permanent Food Act registration, incurring a full registration fee and strict adherence to comply with the structural requirements of the Food Standards Code will apply.

Registration Process

Prior to receiving a temporary Food Act registration, the following requirements must be completed:

  • The application must be submitted at least one week prior to the event, late applications may be rejected or charged a commercial fee.  Charities and not-for-profit organisations are not charged a fee, but a fee does apply to commercial operators (select Food Act Fees & Charges from RELATED DOWNLOADS on the right hand side of page);
  • Complete and sign a temporary Food Act registration form or use the step by step guides; (select Forms and Guides at the end of this page);
  • An Event Food Safety Program must be lodged with Council and an Event Co-ordinator indicated.  A copy of the Event FSP can be downloaded from the Food Safety Victoria website (select DHS - Food Safety web site from RELATED LINKS on right hand side of page) or obtain a hard copy from the Council offices;
  • If the stall is operating on Council land, the applicant must provide evidence of current Public Liability Insurance (min. $5 Million coverage) and this must be attached to the registration form;
  • If the stall is operating from a footpath or public car park then a street stall permit is required, (select Street Stall Permit from RELATED STORIES on the right hand side of page)
  • After the assessment, if all requirements are met a temporary Food Act registration is granted and a certificate is mailed to the applicant.

NOTE: It is an offence to operate any food premises without a Food Act registration.
