Subpoenas

This page provides information on issuing and serving a subpoena on the City of Whittlesea.

Issuing a subpoena

If you are issuing a subpoena for production, it must be addressed to the Chief Executive Officer (CEO) or the Proper Officer of Council. Subpoenas that are not addressed this way may not be accepted.

If you are issuing a subpoena to give evidence, it must be addressed to the specific Council officer who is required to give evidence in their capacity as an officer of Council.

Serving a subpoena

A subpoena for production may be served on Council using one of the following methods:

Timeframes and return dates

Please allow a minimum of 14 days for Council to locate and identify documents that fall within the scope of a subpoena for production.

If Council is unable to comply with a subpoena by the return date, we will contact the Court before that date to request an extension of time.

Describing the documents sought

Clearly and specifically describing the documents you are seeking will help Council process the subpoena more efficiently.

Requests that are very broad or unclear may take longer to comply with and may result in additional costs.
