Asset Protection Permit

About the Asset Protection Permit

Our asset protection requirements aim to provide a safe environment for the community and reduce our costs. They are included in ourCommunity Local Law 2024.

When doing building work, an Asset Protection Permit sets to conditions for building and other works to protect nearby Council assets from damage. This includes:

  • footpaths
  • kerbs
  • vehicle crossing
  • pits
  • nature strips
  • street trees
  • roads
  • drains
  • trees
  • and other Council assets. 

These types of development require an Asset Protection Permit:

  • One unit or house built on a single lot
  • New dwelling in addition to an existing dwelling (dual occupancy)
  • Garage
  • Balcony
  • Veranda
  • Swimming pool e.g. in ground, above ground and/or spa
  • Shed
  • Retaining wall
  • Demolition
  • Extension
  • Internal driveways
  • Stumping
  • Two or more residential unit developments
  • Commercial developments (including retail shops, restaurants, childcare centres, schools, medical centres, hospitals, aged care facilities, hotels and boarding houses)
  • Industrial developments (including warehouses, factories, petrol stations, carparks)
  • Mixed use developments (including shopping centres).

To apply for an Asset Protection Permit, a non-refundable administration fee must be paid. 

If works begin without an Asset Protection Permit, an infringement notice will be issued, and we will assume all assets were in satisfactory condition prior to the works starting. Any damage will be attributed to the building works at your site.

Security bond

Before you start works, all applicants for an Asset Protection Permit must pay a security bond to protect Council assets from damage.

This requirement is outlined in the Asset Protection Permit conditions and the Community Local Law 2024-2034.

Bond amount

The bond amount is determined by the type of Council assets surrounding the site. We will inspect the assets within five business days to determine the amount and provide you with a report.

The amount is calculated based on the site and surrounding assets. An invoice will be issued to you and must be paid before work begins.

Release of bond

To have your bond released, Council will need to carry out a final inspection.

Before requesting this inspection, please make sure that:

  1. All building, construction, and landscaping work, including driveways and paths has been completed
  2. All building materials, rubbish, and mud have been removed from the road, footpath, driveway, and nature strip
  3. The nature strip has been restored to its original condition, with level topsoil and grass seed
  4. Any damage to Council property has been repaired.

Once all these steps are done, you can notify us by completing a  Notice of Completion form.  

After the inspection, if we are satisfied that no damage has occurred or damage has been repaired, your bond will be refunded within 30 days.

If there is unrepaired damage, some or all of the bond may be kept to cover repair costs. If the bond does not cover the full cost of repairs, you will be required to pay the difference.

Ongoing projects

If another party takes over the project for additional works, they must obtain a new Asset Protection Permit and pay their own bond before your bond is released.

Examples of additional works include:

  • Landscaping
  • Internal driveways
  • Retaining walls.

Please note that application fees for the Asset Protection Permit is not refundable. A security bond is payable for all Asset Protection Permits under the Community Local Law 2024-2034.
